My name is Donald Kilpatrick and I was called to the bar of Ontario in 1976. Since then I have practised law in London. For the last 30 years,, almost all the work that I have done has been in the area of family law, though recently I began to do some estate litigation. Most family law disputes can be settled without the need for a trial and, most cases, in fact ,do settle before going to trial. My preference Is always to try to settle family law disputes and to do so on terms that are reasonable to my client and acceptable to the other party.In order to settle family law disputes, there must be a certain amount of give-and-take on both sides. Most family law disputes can be settled if the parties choose to act reasonably and they are represented by lawyers who are experienced in family law. In addition to going to court, I prepare separation agreements for people who are able to resolve their differences without going to court all, which is the best way. Avoid the court house except when it's absolutely necessary. The only time you have no choice but to go to court is to get a divorce. All of the other matters can be settled by the parties if they both want to do so. I also prepare cohabitation agreements for people who are living together or who are about to live together. In most cases, a cohabitation agreement can be worded in such a way that it becomes a marriage contract if the parties marry and a separation agreement if he parties separate. Separation is a lot easier for parties if they have a cohabitation agreement. I also prepare Wills andPowers of Attorney for clients.
